Compliance & Consequence with NRSWA Requirements

The importance of having an up-to-date New Roads and Street Works Act 1991 or NRSWA Card with the correct credentials is widely understood.

It is essential for Operatives and Supervisors that they have the correct licensing when carrying out their duties and are doing so to the standard prescribed by the HAUC coinciding with the New Roads and Street Works Act (NRSWA), current legislation, and Approved Codes of Practice.

However, there is a widespread number of issues that can come about due to having either an expired card or not having one at all.

If you work on the highway without a valid Street Works (NRSWA) card, you could face several consequences, including:

1. Legal Penalties – It is a legal requirement under the New Roads and Street Works Act 1991 (NRSWA) for operatives and supervisors to be properly accredited. Working without a valid street works card could result in fines or legal action against both you and your employer.

2. Site Removal – Local authorities or site inspectors may remove you from site if you cannot provide proof of valid accreditation.

3. Company Liability – Your employer could face penalties or fines for allowing unqualified workers to perform street works, and it could impact their ability to secure future contracts.

4. Insurance Issues – If an accident occurs and you don’t have the proper qualification, the company’s insurance may be invalidated, leading to significant financial risks.

5. Work Delays – Without the correct certification, work may have to stop until a qualified individual is present, leading to project delays and potential financial losses.

If your card has expired or you don’t have one, it’s best to complete the necessary training as soon as possible to avoid these risks.

With a multitude of courses available, the essential levels of certification include:

Full Operative (Yellow Card)

Full Supervisor (Blue Card)

Combined Operative & Supervisor (White Card)
